These terms and conditions (the "Terms and Conditions") govern the use of https://collectorspursuit.com (the "Site"). This e-commerce Site is owned and operated by Collector’s Pursuit. In using this Site, it implies that you have read and understood these Terms and Conditions and agree to abide by them at all times.

 

Intellectual Property
All content publications made available on our Site is the property of Collector’s Pursuit and its creators. These publications include, but are not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

 

Accounts
Upon creating an account on our Site, you agree to the following:

1. ​You are responsible for the privacy and security of your account, including its passwords or any sensitive information; and

2. All personal information that you provide to us through your account is accurate, up to date and truthful, and that you will update your personal information if or when it changes.

 

We reserve the right to suspend or terminate your account if you use our Site illegally or if you violate these Terms and Conditions.

 

Sale of Goods
These Terms and Conditions govern the sale of products available on our Site, which include the following:

• Collectible Card Games (CCG);

• Funko; and

• CCG & Funko accessories.

 

These Terms and Conditions are applicable to all the products on our Site at the time you access it. This includes items that are out of stock. All information, descriptions, or images that we provide about our goods are as accurate as possible. However, we are not legally bound by such as we cannot guarantee the accuracy of all merchandise provided by manufacturers. You agree to purchase goods from our Site at your own risk.

 

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, you will be given a refund equal to the payment amount. You agree that it is your responsibility to monitor your payment instrument to verify the receipt of any refund.

 

Third Party Goods and Services
Our Site may offer goods and services from third parties. However, we cannot guarantee the quality or accuracy of these goods and services.

 

Payments
We accept the following payment methods on our Site:

• VISA Debit;

• Credit Card; and

• PayPal.

 

When you provide us with your payment information, you authorize our use and access to your payment instrument. In providing us with your payment information, you authorize us to charge the amount due to this payment instrument. If we believe your payment is in violation of any law which includes our Terms and Conditions, we reserve the right to cancel or reverse your transaction.

 

Shipping & Handling
The handling time for all orders is 1-2 business days. When you purchase products from our Site, the items will be shipped using the following services:

• Canadian Customers (Canada Post Regular Parcel); and

•  U.S. Customers (Tracked Packet USA).

Please allow between 1-10 business days for delivery, taking into consideration weekends, public holidays, severe weather conditions, high mail volumes or other unforeseen circumstances.

 

We are not liable for deliveries at an incorrect address or wrong person as a result of you providing us with inaccurate or incomplete information. Should an order return to us, we reserve the right to request an additional shipping fee to resend the item(s).

Local Pickup

We offer a free local pickup option in the downtown Ottawa (ON) region. You can select this option during the checkout process. However, since we're an online shop, we will need to set up a date & time, therefore please wait for an email notification before picking up your order. The email will include a telephone number (call/text) to make the necessary arrangements.

 

Note that an order confirmation will be required upon arrival.

Customs, Taxes & Import Charges (U.S. Customers)

U.S. customers, note that Collector's Pursuit is not responsible for any custom duties, taxes or import charges on your order(s). Please refer to your country's customs office for rates and guidelines.

 

Free Shipping

All orders of $200 CAD before taxes qualify for free shipping.

 

Pre-Orders

A pre-order is the sale of a product before its commercial release with the understanding that it will be shipped when it becomes available through the Site. The pre-order arrival dates are subject to change without notice. Collector’s Pursuit will do its best to update these arrival dates should the item(s) not arrive on time.

 

Cancellations

You can cancel pre-orders up to 24 hours after the original purchase date and time. Cancellations beyond that time frame will involve a 10% processing fee. Cancellations on in-stock items can be done at ay time for as long as your order has not shipped.

 

Refunds
Refund requests must be made within 3 calendar days after the receipt of your order. We accept refund requests for goods sold on our Site for any of the following reasons:

• Item(s) sustained damage during transit;

• Receipt of incorrect item(s); and

• Item(s) do(es) not match description.

 

If we deem a refund valid for any other reason, it will be provided in the form of a store credit.

 

Exclusions

Collector’s Pursuit does not offer refunds on goods that have been opened or removed from their original packaging. Small manufacturer flaws or tares in product seals are also not a basis for returns.

 

U.S. Customers, Collector’s Pursuit will not offer refunds or returns for the application of custom duties, taxes or import charges on your order(s).

 

Returns
To return a product, contact support@collectorspursuit.com with a descriptive reason for the return. If we deem the request valid (i.e., receipt of incorrect item), we will provide a return shipping label with mailing instructions.

 

Consumer Protection Law
These Terms and Conditions will not limit your legal rights and remedies under the legislation of the Consumer Protection Act, or any other consumer protection legislation in your jurisdiction. These Terms and Conditions will also be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and the legislation, the mandatory provisions of that legislation will supersede.

 

Limitation of Liability
Collector’s Pursuit and its directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities or expenses including legal fees from your use of the Site.

 

Indemnity
In using this Site, you indemnify and hold harmless Collector’s Pursuit and its directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities or expenses including legal fees arising out of the use of our Site or your violation of these Terms and Conditions.

 

Applicable Law
These Terms and Conditions are governed by the laws of the Province of Ontario.

 

Severability
If the provisions set forth in the Terms and Conditions are found to be inconsistent or invalid at any time under applicable laws, those provisions will be considered void and removed from these Terms and Conditions. All other provisions will not be affected by this removal, the remaining Terms and Conditions will continue to be valid.

 

Changes
From time to time, Terms and Conditions will require amendments in order to maintain compliance with the law, as well as reflect changes to the way we operate our Site and the behavior of its users. We will advise our users of changes to these Terms and Conditions via email or notification on our Site.
